Terms of Use

1. Who we are

DraftProse is a writing tool published by Argonode Studio (“we,” “us,” “our”). These Terms govern your use of the DraftProse application, website, and any associated services (collectively, the “Service”). By using the Service you agree to these Terms.

2. Your account

You are responsible for the email address tied to your account and for anyone who has access to it. We authenticate you via single-use email links; we do not use passwords. You must be at least 13 years old (or older if the law where you live requires it).

3. Your prose stays yours

You own everything you write in DraftProse. We claim no copyright, no license to publish, and no right to derivative works. The Service stores your manuscripts solely to display them back to you and to run the Reader at your request. We do not train any model on your prose. We do not sell, license, sub-license, or otherwise transfer your prose to any third party.

You may export everything you have written at any time. You may delete your account at any time from Settings → Account; we irrevocably erase your manuscripts within thirty (30) days of deletion, retaining only the minimum records required to satisfy billing, tax, and legal obligations (account email, payment history, audit logs).

4. The Reader

When you click a Reader surface (pacing read, plot read, character voice workshop) we send the minimum required context to the provider you have chosen (Anthropic, OpenAI, Google, or your local endpoint). The exact text sent is visible to you via the inspect button on every read.

The Reader is a structural-analysis tool. It does not write your manuscript and never auto-inserts text into your document. We do not warrant the accuracy of any read, observation, or character-voice response. Treat its output as ideation, not advice.

When you connect your own AI account, your relationship with that provider is governed by their terms. We are not party to that relationship and bear no responsibility for charges, outages, or policy decisions on their side.

5. Optional add-on modules (audio, image, and video)

Some features are optional, off by default, and generate media from your scene text using a third-party provider and your own provider key: the Table read (speech, via ElevenLabs), the Scene visualizer (concept images, via OpenAI), and Scene to video (short clips, via fal.ai). In some cases we may provide limited access to a module without your own key. Either way, when a module runs we send the relevant scene text to that provider for processing.

Your use of each provider is governed by that provider’s own terms and content policies. We are not a party to that relationship and we accept no responsibility for it, including their charges, outages, data handling, content filtering, or policy decisions.

Anything these modules produce is generated content, supplied “as is.” We do not create it, do not review it, and do not warrant that it is accurate, original, non-infringing, or fit for any use. You are solely responsible for the prompts you submit, for how you use any output, and for ensuring you hold the rights you need. We accept no responsibility or liability for generated output or for any use you make of it. We do not retain the generated media.

6. Acceptable use

You agree not to use the Service, including any generative module, to:

  • infringe anyone else’s intellectual property, or import, store, or share a manuscript you do not own or have the rights to use;
  • create, request, or store content that depicts the sexual exploitation of minors;
  • generate the voice, face, or likeness of a real, identifiable person, or any deepfake; the modules and the character voice workshop are for your own fictional characters only;
  • harass, threaten, or defame any identifiable person;
  • produce content that is unlawful where you live or where the Service operates;
  • attempt to break, scrape, or overload the Service, or to evade usage limits.

We may suspend or terminate accounts that violate these rules, and we maintain a copyright takedown process.

7. Pricing and payment

The Free tier is free. Paid tiers (Studio, Pro) are billed monthly or annually in advance through our payment processor. You can cancel at any time from Settings → Account; access continues until the end of the current billing period. Subscriptions auto-renew at the start of each period unless cancelled.

We will issue a pro-rated refund if you cancel within fourteen (14) days of an annual renewal and have not used a paid Reader surface in that window. Outside of that, payments are non-refundable; we may grant exceptional refunds in good faith and at our sole discretion.

8. Termination

You can delete your account at any time from Settings → Account. Deletion is permanent. We may terminate your account if you violate these Terms; we will give reasonable notice except in cases of clear, serious abuse.

9. Disclaimer of warranty

The Service is provided “as is.” To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise the Service will be available at all times, free of bugs, or suitable for any particular publishing pipeline.

10. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is limited to the greater of (a) what you paid us in the twelve months before the claim arose, or (b) one hundred United States dollars. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost manuscripts, lost royalties, lost opportunity, or distress arising from any unavailability or bug.

Your manuscript is precious. Back it up elsewhere too. We recommend git, Time Machine, or anywhere else you trust outside our control.

11. Indemnity

You agree to defend and indemnify us against any third-party claim arising from your content or your violation of these Terms. We will tell you promptly of any such claim and let you control the defence if you wish.

12. Changes to these Terms

We may update these Terms. If a change is material we will notify you by email at the address on file at least thirty days before it takes effect. Continued use after the effective date constitutes acceptance. If you do not agree, you may delete your account.

13. Governing law and disputes

These Terms are governed by the laws of England and Wales. You and we agree that the courts of England and Wales have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms, except that we may seek injunctive relief in any jurisdiction where you reside or do business.

Nothing in this section limits any non-waivable consumer rights you may have under the law of your country of residence.

14. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions stay in full force. These Terms together with our Privacy Policy constitute the entire agreement between you and us regarding the Service and supersede any prior agreement on the same subject. Our failure to enforce any provision is not a waiver of our right to enforce it later.
